Employers: Prepare to Submit EEO-1 Pay Data by September 30, 2019

The EEOC has confirmed that it will collect 2018 EEO-1 pay data (Component 2) by September 30th, 2019, responding to Judge Tanya Chutkan’s recent court order. In addition to requiring 2018 pay data, Chutkan gave the EEOC the choice of collecting 2017 pay data by the September 30th deadline or collecting 2019 pay data during the 2020 reporting period. Today, on May 2nd, the EEOC decided to collect 2017 data.

The agency expects to open their portal for Component 2 collection by mid-July and will notify filers of the precise opening date as soon as it’s available. Though there’s still a possibility of the federal government appealing this decision, it’s still very important that employers are familiar with the Component 2 requirements and that they start preparing accordingly.

Keep in mind that the deadline to submit race, ethnicity, and gender data (Component 1) is still May 31, 2019.

Does this affect me?

Employers with 100+ employees and federal contractors with 50+ employees (and at least $50,000 in contracts) are required to file EEO-1.

What are the due dates for reporting?

May 31st for Component 1 data (race, ethnicity, gender) and September 30th for Component 2 data (how much was paid to workers of different sexes, ethnicities, and races).

Does DP file this information for us?

No. However, if you have utilized iSolved for entering the Component 1 EEO-1 information, you will be able to easily generate reports with this data from iSolved.*

*This setup involves associating EEO Category information with Job Titles and making sure each employee is assigned to a job so that we can accurately capture the amount each individual was paid.

Is my company compliant?

If you have filed Component 1 by May 31st and Component 2 by September 30th, you are in compliance.
